These terms govern your use of melanixhealth.com and the Field Notes email, operated by Melanix Health Inc. ("Mela," "we," "us"). By accessing or using the site, or by subscribing to the Field Notes list, you agree to these terms. If you do not agree, please do not use the site. The Mela application is not yet available; when it launches it will have its own terms, and your use of it will be governed by those terms rather than these.
Who may use the site
The site is intended for a general adult audience and is not directed to children. You must be at least 16 years old (or the age of digital consent in your jurisdiction, if higher) to subscribe to the Field Notes list. By using the site, you represent that you meet this requirement and that your use complies with all laws that apply to you.
Not medical advice
Mela provides general wellness and educational information about skin, based on published research. It is not medical advice and is not a substitute for professional care. Reading this site, subscribing to Field Notes, or contacting us does not create a doctor-patient relationship or any other professional or fiduciary relationship between you and Melanix Health Inc. or its authors. Mela does not diagnose, treat, cure, or prevent any disease or condition. Always consult a board-certified dermatologist or qualified clinician for personalized medical advice. Persistent, severe, or scarring conditions are a matter for a clinician, not a tracking tool. Never disregard, avoid, or delay seeking professional medical advice because of something you have read on this site or in Field Notes. Do not rely on this content as the basis for any health decision; any action you take based on it is at your own risk. If you think you may have a medical emergency, call your doctor or your local emergency number immediately. A short version of this disclaimer appears on each Field Note.
Skin is individual. The research findings we describe reflect the specific populations studied and may not apply to you; individual results vary, and nothing here predicts how your skin will respond. Statements about skin on this site are general educational summaries of published research, cited to their sources; they are not promises of results and are not a substitute for individualized clinical judgment.
Use of the site
You may read, share, and reference our content for personal, non-commercial purposes. You agree not to:
- use the site in violation of any law or in a way that infringes anyone's rights;
- attempt to disrupt, overload, or interfere with the site or its security, or probe or scan it for vulnerabilities;
- use automated means (bots, scrapers, crawlers) to harvest content or email addresses, except for well-behaved search-engine indexing that respects our robots directives;
- copy, republish, or redistribute our content wholesale, or frame or mirror the site, without our permission (brief, attributed excerpts are fine, as described below).
Suspension and availability
We may modify, suspend, or discontinue the site (or any part of it) at any time, and we may block or restrict access for anyone who violates these terms or misuses the site, in each case without notice or liability. Sections of these terms that by their nature should survive — including intellectual property, disclaimers, limitation of liability, and governing law — will survive any termination of your access.
Content and intellectual property
The writing, figures, and design on this site are © Melanix Health Inc. unless otherwise noted. Field Notes cite their sources; cited works belong to their respective authors and publishers. You may quote brief excerpts with attribution and a link. Our citation-integrity and corrections policy is described in the Field Notes.
Links to other sites
Our content cites and links to third-party websites, research, and resources that we do not operate or control. We provide these links for reference only. We are not responsible for the content, accuracy, or practices of any third-party site, and a link does not imply our endorsement. Accessing third-party sites is at your own risk and subject to their terms and privacy policies.
Endorsements and sponsorship
We do not currently run advertising, paid endorsements, sponsored content, or affiliate links, and our health statements are sourced to published research. If that ever changes, we will clearly and conspicuously disclose any material connection — such as a paid endorsement, sponsorship, or affiliate commission — at the point it appears, consistent with the FTC's Guides Concerning the Use of Endorsements and Testimonials (16 C.F.R. Part 255).
The Field Notes list
If you subscribe, you will receive Field Notes when we publish and the occasional important announcement (such as the app launch). You can unsubscribe at any time using the link in every email. Your information is handled per our Privacy Policy.
Disclaimers and limitation of liability
The site and all content are provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the site will be uninterrupted, error-free, or secure, or that any content is complete, current, or reliable for any particular purpose.
To the fullest extent permitted by law, Melanix Health Inc. and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the site or your reliance on any content, whether based in contract, tort, statute, or otherwise, even if we have been advised of the possibility of such damages.
To the fullest extent permitted by law, our total aggregate liability for all claims relating to the site or these terms will not exceed one hundred U.S. dollars (US $100).
Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, so some of the above may not apply to you. Nothing in these terms excludes or limits any liability or any rights that cannot be excluded or limited under applicable law — including the mandatory consumer-protection and data-protection rights you may have in your country of residence, and including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for gross negligence or willful misconduct.
Changes
We may update these terms from time to time. When we do, we will revise the "Last updated" date above and, for material changes, summarize what changed at the top of this page. Changes are effective when posted, and your continued use of the site after that constitutes acceptance of the updated terms. If you do not agree to the updated terms, please stop using the site.
Governing law
These terms are governed by the laws of the State in which Melanix Health Inc. is incorporated, in the United States, without regard to its conflict-of-laws rules. To the extent permitted by applicable law, you agree that the state and federal courts located in that state have exclusive jurisdiction over any dispute arising from these terms or your use of the site, and you consent to the personal jurisdiction of those courts.
General
Entire agreement. These terms, together with our Privacy Policy, are the entire agreement between you and Melanix Health Inc. regarding the site and supersede any prior understandings.
Severability. If any provision of these terms is held to be unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
Assignment. You may not assign or transfer these terms. We may assign them, for example in connection with a merger, acquisition, or sale of assets.
